Privacy Policy

This privacy policy explains the information we collect, how we use and share it, how to manage your privacy controls to the extent you create an account, and your rights in connection with our website and our mobile application Cues (collectively, the Services). Please also read our terms of use (the Terms), which set out the terms governing the Services.

The Services are provided to you by #include tech. (#include tech., we, us or our). We are responsible for the personal information we process about you as described in this policy.

Questions or comments about this privacy policy may be submitted by email to hi@cues.app.

Information we may collect

We collect information about you, including information that directly or indirectly identifies you, if you choose to share it with us. We receive information in a few different ways, including when you join our waitlist, create an account, or use the app. If you create an account, we also collect information about how you use the Services.

Waitlist and contact information

When you join our waitlist, we collect your email address so we can confirm your request, let you know when Cues is available, and send you an invitation to try early builds of the app. When you contact us, we use your contact information and the content of your message so we can respond to your support requests and comments.

Account and profile information

If you create an account, we collect the information you provide, such as your name, email address and any profile details you choose to add. We also collect information about how you use the Services, such as the features you use and the settings you choose.

Content and activity information

Cues is a video editor. The videos, photos, audio and other material you import into the app are stored on your device and are processed there in order to provide the editing features you use. If you choose to use a feature that requires our servers, for example to share, sync or export a project through the Services, we process the content involved only to the extent necessary to provide that feature. We do not access your library or your projects otherwise.

Third-party accounts

Where the Services allow you to sign up or log in using an account you hold with a third-party service, such as Apple or Google (Third-Party Accounts), we will collect the information you have agreed to make available through that service, such as your name and email address. This information is collected by the Third-Party Account provider under its own privacy policy. You can generally control the information we receive from these sources using the privacy controls in your Third-Party Account.

Payment information

If you purchase a subscription or other paid feature, your payment is processed by the app store through which you made the purchase or by a payment-industry compliant third-party payment provider. We do not receive or store your payment card details. We may receive confirmation of your purchase and the status of your subscription so we can provide the features you have paid for.

Technical information

We collect information from your browser, computer or mobile device when you access or use the Services. This technical information includes device and network information, app version, crash reports, log files and analytics information. Our website uses privacy-focused analytics to understand how it is used; this analytics data is aggregated and does not identify you personally.

Other information

We may collect information from you through third parties, such as when we collect your feedback through surveys. The Services use log files. The information stored in those files includes IP addresses, browser type, referring and exit pages, platform type, date and time stamp, and number of clicks. This information is used to analyze trends, and to administer, protect and secure the Services. IP addresses may be linked to session IDs and device identifiers.

How we use your information

We use the information we collect and receive to provide the Services for the following purposes.

To provide the Services

We use the information we collect and receive to provide the Services, including to operate the app, deliver the features you use, keep your account working, and, where you use features that rely on our servers, to store, share or sync your projects on your instruction.

To customize your experience

We use the information we collect about you and your activities to customize your experience. For example, we may suggest new features that may interest you.

To protect the Services

We use the information we collect to enforce our Terms. For example, we find and remove accounts that violate our terms, and we detect and prevent fraud, abuse and security incidents.

To improve the Services

We also use the information we collect to analyze, develop and improve the Services. To do this, we may use third-party analytics and crash reporting providers to gain insights into how the Services are used and where they fail, so that we can improve them.

To communicate with you

We use the information we collect to provide support in response to your requests and comments, to confirm your waitlist signup, to send you invitations to early builds, and to send you service-related notices such as changes to these policies.

Promotion of the Services

We may also use the information we collect to market and promote the Services and new features, including by email and push notifications, where you have not opted out of receiving such messages and, for push notifications, where you have approved receiving them. You can unsubscribe from marketing emails at any time using the link in the email or by contacting us.

To process your subscription

We use the information we collect to process and manage your subscription and to provide you with the features you have paid for, in accordance with our Terms.

Third-party integrations

The Services may enable you to share your content with third-party apps, platforms or websites, for example when you export a video to a social network. Information collected by these third parties is subject to their terms and policies. We are not responsible for the terms or policies of third parties, and we advise you to read their privacy conditions and settings carefully.

Affiliates and acquirers of our business or assets

We may share your information with affiliates under common control with us, who are required to comply with the terms of this privacy policy with regard to your information. If we become involved in a merger, acquisition, financing, reorganization, bankruptcy, dissolution or other similar transaction, we may share or transfer your information in connection with such a transaction. If we engage advisors in relation to a potential transaction, they are obliged to comply with the conditions in this privacy policy. When there are changes in the way your personal information is handled, we will first communicate this to you.

Protection of your information

We take several measures to safeguard the collection, transmission and storage of the data we collect. We employ reasonable protections for your information that are appropriate to its sensitivity. The Services use industry-standard transport encryption (TLS) to protect information in transit, and information stored on our behalf is protected by access controls and encryption at rest. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.

Third-party service providers

We may share your information with third parties who provide services to us, such as hosting, data storage, email delivery, analytics, crash reporting, customer support and payment processing. These service providers only have access to the information necessary to perform these limited functions on our behalf and are required to protect and secure your information.

Your rights

You can request to exercise the following rights with regard to your personal information.

Withdrawing permission

Where you have previously provided your consent, for example to receive marketing emails or push notifications, you have the right to withdraw your consent at any time by updating your settings or contacting us. In certain cases, we may continue to process your information after you have withdrawn consent if we have another basis to do so, or if your withdrawal of consent was limited to certain processing activities.

Access to your information

You can ask us which personal information we hold about you. If we do, we will tell you which personal information is processed, for what purpose, with which third parties it is shared, how long it is kept, and where it came from if we did not collect it from you.

Correct, restrict or delete

You can correct, restrict or delete much of your information yourself, for example by editing your profile, deleting projects, or deleting your account. You can also contact us if you are unable to do so yourself. You can ask us to limit the processing of your personal information while its accuracy is disputed, or while a request you have made is being handled. In that case, we will still store the data, but we will not process it further.

Objection

You can object to our processing of your information in certain circumstances. In such cases, we will stop processing your information unless we have compelling legitimate grounds to continue, or where it is needed for legal reasons.

Data portability

You can ask us to provide the personal information you have given us in a structured, commonly used and machine-readable form.

Contact us

You can submit a request to exercise the above rights by contacting us at hi@cues.app. We aim to respond within three weeks of receiving the request.

Legal requirements

We may preserve and share your information with third parties, including law enforcement, public or governmental agencies, or private litigants, within or outside your country of residence, if we determine that such disclosure is allowed by law or reasonably necessary to comply with the law, including to respond to court orders, warrants, subpoenas, or other legal or regulatory process. We may also retain, preserve or disclose your information if we determine that this is reasonably necessary or appropriate to prevent any person from death or serious bodily injury, to address issues of public importance, to prevent or detect violations of our Terms, or to protect our operations, our property or other legal rights, including by disclosure to our legal counsel and other consultants and third parties in connection with actual or potential litigation.

Retention of information

Retention period

We retain information as long as it is necessary to provide the Services to you and others, subject to any legal obligations to further retain such information. Information associated with your account will generally be kept until it is no longer necessary to provide the Services or until your account is deleted. You can delete some items of information, such as profile information, without deleting your account. Waitlist email addresses are kept until you unsubscribe or ask us to remove them. Please note that following the deletion of your account, it may take up to 90 days to fully delete your personal information and system logs from our systems. Additionally, we may retain information to comply with the law, prevent fraud, collect fees, resolve disputes, troubleshoot problems, assist with investigations, enforce the Terms and take other actions permitted by law. The information we retain will be handled in accordance with this privacy policy.

Aggregation

Information connected to you that is no longer necessary and relevant to provide our Services may be de-identified or aggregated with other non-personal data to provide insights that are useful to us, such as statistics about the use of the Services.

Where your information is stored

We are based in India. Your information may be stored and processed in India and in other countries where we or our service providers operate. Wherever your information is processed, we take steps to ensure it receives a level of protection consistent with this privacy policy.

Changes to this privacy policy

We reserve the right to modify this privacy policy at any time. Please review it occasionally. If we make changes to this privacy policy, the updated policy will be posted on the Services in a timely manner and, if we make material changes, we will provide prominent notice. If you object to any of the changes to this privacy policy, you should stop using the Services and, if you have created one, you should delete your account.
